Assumption of risk & liability waiver

By renting equipment from RechargeKit, you voluntarily assume all risks associated with the use of fitness recovery equipment, including but not limited to percussion massage devices, compression therapy systems, foam rollers, cold therapy equipment, heat therapy devices, and LED light therapy masks.

You acknowledge that the use of such equipment carries inherent risks, including the possibility of physical injury, and that RechargeKit, its owners, employees, agents, and representatives are not liable for any injury, illness, harm, or adverse reaction resulting from your use of rented equipment.

Equipment use & safety

Renter agrees to use all equipment only as intended by the original manufacturer and in accordance with included instructions or guidance provided at delivery. Specifically, renter agrees to:

• Read and follow all manufacturer safety warnings before use
• Not use equipment if experiencing acute injury, open wounds, skin infections, or circulatory conditions without prior medical clearance
• Not allow minors under the age of 18 to use equipment without direct adult supervision
• Keep all electrical equipment away from water unless specifically designed for wet use
• Not disassemble, modify, or tamper with any equipment
• Immediately discontinue use if pain, discomfort, numbness, or unusual sensation occurs
• Store equipment safely when not in use to prevent damage or theft

RechargeKit is not responsible for injuries resulting from improper use, misuse, or failure to follow manufacturer guidelines.

Medical disclaimer

RechargeKit is a rental service and is not a medical provider. Nothing provided by RechargeKit, including equipment, delivery staff communications, website content, or marketing materials, constitutes medical advice, diagnosis, or treatment.

Consult your physician or a licensed healthcare provider before using any recovery equipment if you have or suspect you may have any of the following:

• Deep vein thrombosis (DVT) or blood clot conditions
• Heart conditions or pacemakers (particularly relevant to compression and LED devices)
• Pregnancy
• Recent surgery or open wounds
• Skin conditions, rashes, or photosensitivity (particularly relevant to LED masks)
• Peripheral neuropathy or reduced sensation
• Any condition that may be affected by cold, heat, pressure, or light therapy

Equipment damage & loss

A refundable security deposit of $50.00 is collected at the time of booking. The deposit will be returned in full following pickup, provided equipment is returned in the same condition as delivered, reasonable wear excluded.

Renter is financially responsible for:

• Damage beyond normal wear: Renter will be charged the cost of repair or replacement at RechargeKit's discretion
• Loss or theft: Renter is responsible for the full replacement cost of any unreturned equipment
• Cleaning fees: Equipment returned in an unsanitary condition will incur a cleaning fee of up to $50.00 per item

RechargeKit reserves the right to charge the payment method on file for any amounts owed beyond the security deposit. Renter will be notified of any such charges within 48 hours of equipment pickup.

Rental terms & cancellation

All rentals are subject to the following terms:

• Minimum rental period: 1 day
• Maximum rental period: 14 consecutive days
• Cancellation — 24+ hours before delivery: Full refund of deposit
• Cancellation — less than 24 hours before delivery: 50% refund of deposit
• No-show or failure to provide access: No refund; full rental fee may apply
• Extension requests: Must be submitted before scheduled pickup date and are subject to availability

RechargeKit reserves the right to cancel any booking due to equipment unavailability, service area limitations, or circumstances beyond our control. In such cases, a full refund will be issued within 3 to 5 business days.

Sanitation & hygiene

RechargeKit is committed to the health and safety of all customers. All equipment is professionally cleaned and sanitized between each rental using medical-grade disinfectants following CDC-aligned protocols.

LED face masks are delivered with single-use disposable silicone liners or fabric covers. Renter agrees to use the provided hygiene accessories and not to share the mask with other individuals without replacing the liner.

Despite our rigorous sanitation protocols, RechargeKit cannot guarantee that equipment is free from all pathogens. Renters with compromised immune systems are advised to consult a physician before use.

Limitation of liability

To the fullest extent permitted by applicable law, RechargeKit and its owners, officers, employees, agents, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

• The use or inability to use rented equipment
• Personal injury or property damage resulting from equipment use
• Equipment malfunction, defect, or failure
• Delivery delays or scheduling conflicts
• Any adverse health outcome related to equipment use

In no event shall RechargeKit's total liability to any renter exceed the total amount paid by that renter for the specific rental giving rise to the claim.

Indemnification

Renter agrees to defend, indemnify, and hold harmless RechargeKit and its owners, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Renter's use or misuse of rented equipment
• Renter's violation of these terms
• Injury or damage caused by renter to any third party through use of equipment
• Renter's negligence or willful misconduct

Governing law & dispute resolution

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any dispute arising out of or related to these terms or the rental of equipment shall first be submitted to good-faith mediation. If mediation is unsuccessful, disputes shall be resolved by binding arbitration in Palm Beach County, Florida, in accordance with the rules of the American Arbitration Association.

Renter waives any right to participate in a class action lawsuit or class-wide arbitration against RechargeKit.
